Overview

Welcome to Backpocket ("we", "us", or "our"). By accessing or using our web application, browser extensions, mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not use the Service. Please read them carefully.

Eligibility

You must be at least 13 years of age to use Backpocket. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate.

Account Registration

To use the Service, you must create an account through our authentication provider, Clerk. You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access to your account

Each person may maintain only one account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

Acceptable Use

Backpocket is a personal bookmarking tool. You may use the Service to save links, organize them with tags and collections, add personal notes, read saved content in reader mode, and optionally share your saves publicly through spaces.

You agree to use the Service only for lawful purposes and in accordance with these Terms.

Prohibited Content and Conduct

You may not use the Service to save, store, share, or distribute:

  • Illegal content — Any content that violates applicable laws or regulations, including links to illegal material
  • Hate speech — Content that promotes hatred, violence, or discrimination against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Harassment and threats — Content that threatens, bullies, intimidates, or harasses any person
  • Exploitation material — Child sexual abuse material (CSAM) or any content that exploits or endangers minors
  • Spam and malware — Spam, phishing links, malware, or any content designed to deceive or harm users
  • Infringing content — Content in your notes or public spaces that infringes on the copyrights, trademarks, or other intellectual property rights of others
  • Impersonation — Misrepresenting your identity or falsely implying affiliation with any person or organization

You also agree not to:

  • Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service
  • Use automated means (bots, scrapers, crawlers) to access the Service beyond normal use of the browser extension
  • Intentionally overload, disrupt, or interfere with the Service or its infrastructure
  • Circumvent any security measures, access controls, or usage limits we implement

User Content and Ownership

Content You Create

You retain full ownership of original content you create on Backpocket, including your personal notes, annotations, space descriptions, and bio. By making any of this content public, you grant Backpocket a limited, non-exclusive, worldwide license to display and distribute that content solely for the purpose of operating the Service (for example, rendering your public space to visitors).

This license ends when you delete the content or make it private. We will never use your content for advertising, training models, or any purpose unrelated to providing the Service.

Third-Party Content

Content fetched from external websites for snapshots and reader mode remains the intellectual property of its original creators. Backpocket does not claim any ownership of third-party content. This content is stored solely to provide reader mode functionality for your personal use.

You are responsible for ensuring that any content you choose to make publicly visible through your space does not infringe on the rights of third parties.

Public Spaces

Backpocket allows you to optionally share saves, collections, and your profile through a public space. When you make content public:

  • It becomes visible to anyone with the URL, including search engines
  • It may appear in link previews on social media and messaging platforms, including any notes you have attached to public saves
  • We may display a visitor counter and other aggregate, non-identifying metrics

All content is private by default. You have full control over what is made public and can revert content to private at any time.

We reserve the right to remove or hide public content that violates these Terms or that we reasonably believe may expose us or others to legal liability.

Content Snapshots

Backpocket fetches and caches readable content from web pages you save to power reader mode. These snapshots are cached copies of third-party content and are provided as a convenience for your personal reading.

We do not claim ownership of snapshot content. Snapshots may become outdated as the original content changes. Making snapshots publicly visible through your space is at your own risk with respect to the original content creator's rights.

Content Removal and Takedown Requests

We respect the intellectual property rights of content creators. If you are a content creator and believe that your work has been cached or displayed on Backpocket without your permission, you may submit a takedown request.

How to Submit a Takedown Request

To submit a valid takedown request, please provide:

  1. Identification of the copyrighted work or content you believe has been infringed
  2. The URL(s) on Backpocket where the content appears, or enough information for us to locate it
  3. Your contact information (name, email, and, if applicable, the organization you represent)
  4. A statement that you are the rights holder or authorized to act on behalf of the rights holder

Send takedown requests to legal@backpocket.my. We will review and process valid requests in a reasonable timeframe.

We may also proactively remove content if we become aware that it infringes on third-party rights or otherwise violates these Terms.

Intellectual Property

The Backpocket name, logo, visual design, and underlying source code are the property of Backpocket and its creators. Nothing in these Terms grants you any right to use our trademarks, branding, or proprietary materials except as part of normal use of the Service.

Account Suspension and Termination

By Us

We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe you have violated these Terms. In cases of severe violations (such as hosting exploitation material or distributing malware), we may terminate your account immediately and report the activity to the appropriate authorities.

By You

You may delete your account at any time. Upon deletion, we will remove your account data, saved content, snapshots, and any associated public spaces. Some data may persist briefly in backups before being fully purged.

Effect of Termination

Upon termination, your right to access the Service ceases immediately. We are not obligated to retain or provide any of your data after account termination, though you may export your data before deleting your account.

Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, Backpocket and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the Service.

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Backpocket and its creators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your content, your violation of these Terms, or your infringement of any third-party rights.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you through the Service.

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Backpocket operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
